The Challenge:
The port developer and the contractor had reached impasse on many matters of dispute in relation to the contracts between them.
As they were unable to resolve the disputes themselves, they appointed a panel of experts to consider and determine resolution of all the matters using the processes available to them under the contracts.
The Outcome:
The process of determination by the experts was established following a procedure well proven by Flagstaff.
The submissions by the parties were duly lodged and considered, and a joint determination was reached by the experts following due debate and deliberation.
The determination was published to the parties in accordance with the agreed timescale.
