The Challenge:
- In 2010, sections of the road began to fail after periods of rainfall
- Investigation revealed water penetration of the subgrade
- VicRoads and Contractor in dispute over responsibility to reconstruct the drainage system causing the failure and repair damaged sections of the pavement
The Outcome:
Flagstaff appointed as independent expert advisor
VicRoads specified a culvert drainage system in the design and construction tender
The Contractor is a professional business and was responsible for the design and construction of the drainage system
The completed culvert drainage system did not achieve the required falls and was not constructed in accordance with the design
An alternative drainage system (barrel drain in lieu of culvert) should have been identified and documented during the design process
VicRoad’s should be responsible for additional costs for barrel drain over the culvert drainage system specified in the tender documents
The Contractor should be responsible for the balance of the costs for repair and reinstatement
